Θέμα: Παρέλαση Baltic Pride
Μπορεί να ενημερώσει η Επιτροπή εάν τα επιμέρους κράτη μέλη υποχρεούνται να μεριμνούν για την ασφάλεια των ειρηνικών διαδηλώσεων όπως η Baltic Pride, η οποία επρόκειτο να πραγματοποιηθεί στη Λιθουανία στις 8 Μαΐου 2010;
Κατ’ επέκταση, θα ήθελα μια διευκρίνιση ως προς το εάν η ακύρωση της παρέλασης Baltic Pride από τις λιθουανικές αρχές αντιβαίνει στις Συνθήκες της ΕΕ, κυρίως δε στον Χάρτη Θεμελιωδών Δικαιωμάτων, ο οποίος αποτελεί τμήμα της Συνθήκης της Λισαβόνας.

Freedom of peaceful assembly as provided in Article 12 of the Charter of Fundamental Rights of the European Union and in the European Convention of Human Rights is part of the principles upon which the Union is founded. According to Article 51 of the Charter, its provisions are addressed to Member States only when they are implementing the Union law.
Issues pertaining to the organisation of public meetings in the Member States and to the safety of the individuals during those events fall under the competence of the Member States. Therefore, the issue of the compatibility of the decisions by Lithuania with the EU Treaties, and the Charter of Fundamental Rights in particular, does not arise.
The Commission wrote to the Lithuanian authorities to recall that still, Member States are obliged to respect fundamental rights in line with their own constitutional order and international order, including case law of the European Court of Human Rights.
